Commercial litigator Kathryn L. McCann applies her experience in large, complex civil litigation, including class actions involving financial fraud and corporate torts, to represent companies and municipalities of all sizes. Clients benefit from her in-depth case management skills and strategic litigation roadmaps that prioritize clients’ business goals and budgets. Kathryn helped found and launch Annaguey McCann in 2023 to shift the profession toward delivering more value to clients through closer, collaborative and responsive representation. Her litigation practice includes a range of business disputes, from fraud, contract and partnership disputes to real estate litigation and defense of consumer class actions.

Kathryn is known for her impact as an assertive and principled litigator whose focus on fleshing out the facts and crafting compelling arguments lead to favorable and pragmatic outcomes. In addition to extensive trial court experience, Kathryn also has an enviable record of lower court matters being upheld by California state and federal appellate courts. To that end, Kathryn has briefed and argued appellate cases before the California Court of Appeal, the California Supreme Court, and the United States Court of Appeals for the Ninth Circuit.

In her counsel to large municipal authorities regarding civil rights, rates and other issues, Kathryn is always mindful of the duty to safeguard taxpayers’ funds and the public implications of decisions, actions and outcomes.

Kathryn also has experience representing large corporate, institutional clients in real estate, banking and other matters. Clients large and small value her ability to streamline cases, avoid expensive detours, and craft creative resolutions to lawsuits.

Kathryn is an alumna of Loyola Law School and Florida State University. She serves as a volunteer judge in her law school’s trial advocacy and moot court programs. She has been named to the Southern California Super Lawyers “Rising Stars” list, selected to the Los Angeles Business Journal’s “Women of Influence: Attorneys” list in 2022 and 2024, “Thriving in Their 40s” issue in 2023, and “Leaders of Influence: Litigators & Trial Attorneys” in 2024. Kathryn is a longtime supporter of Public Counsel, one of the nation’s leading pro bono law firms. She sits on Public Counsel’s Board of Directors and has led several fundraising campaigns resulting in over $100,000 in donations.

Kathryn’s own pro bono practice includes providing litigation assistance relating to housing issues for underrepresented individuals in the Los Angeles community.

EXPERIENCE

Representative Matters

  • Served as a member of the arbitration team representing a documentary producer against a co-producer. After a contentious arbitration, the arbitrator awarded our client full rights to the disputed footage and over $700,000 in attorneys’ fees. The Los Angeles Superior Court confirmed the arbitration award.
  • Defended a global real estate brokerage company in several complex and related securities fraud class actions, with our client prevailing on demurrer. The California Court of Appeal affirmed.
  • Prevailed on a motion to dismiss in the defense of a global bank in a case involving an alleged conspiracy and RICO violations. The U.S. Court of Appeals for the Ninth Circuit affirmed.
  • Defended one of the nation’s largest commercial real estate owners and developers in a multimillion-dollar premises liability action resulting from an elevator accident. Our client prevailed on summary judgment. The matter was not appealed.
  • Represented a large municipality in its defense of a series of related class actions that led to an over $100 million settlement and has since led the team in managing and overseeing the settlement administration.
  • Defended a large municipality in a civil rights case, with our client prevailing on summary judgment. The U.S. Court of Appeals for the Ninth Circuit affirmed.
